Homosexuality and Mutual Consent

Homosexuality in Ancient Civilizations:

Modern thought consistently argues in favor of homosexuality by asserting that these tendencies have historically always existed among humans. Frequently, examples are drawn from ancient civilizations such as Greece, Rome, and ancient India, where evidence of such practices is found. Based on these historical references, a new philosophy has been formulated in the modern era to provide legal and moral protection to this act, which is termed "Mutual Consent".

The Argument: The Western Premise of "Mutual Consent"

In today's modern civilization and liberalism, the strongest legal and intellectual argument for justifying homosexuality is the principle of "Mutual Consent". The foundation of this argument is that if two adults are establishing a sexual or physical relationship with each other through their own free will and mutual consent, then no external force, society, or third party has the right to interfere.

The concept of consent has gained such paramount importance in the West that the legality or illegality of a sexual relationship is considered to depend solely on this principle, to the extent that the marital status of the relationship has been reduced to secondary importance. Proponents of this philosophy argue that just as there is no legal restriction on a consensual sexual relationship between two different genders (a man and a woman), there should likewise be complete freedom for two individuals of the same gender.

Refutation:  

This premise of Western thought ostensibly appears as an appealing slogan of individual freedom. However, when evaluated against the standards of sociology, history, and common sense, its foundations prove to be hollow. An academic and logical refutation of this theory can be effectively articulated through the following points:

1. Mutual Consent Does Not Validate a Crime

In any civilized society, the mere mutual consent of two individuals is by no means sufficient to provide moral or legal justification for an act. Instead, every action is judged against the touchstone of the society's overall discipline and order. If consent alone were the ultimate proof of justification, then the exchange of bribes, which also occurs with the mutual consent of two individuals, would not be considered a serious crime punishable by law. Similarly, the exchange of dowry in society is settled with the consent of both parties, yet it is acknowledged as a social evil, and laws have been enacted to prevent it. Therefore, the logic that an evil committed with the mutual consent of two individuals should become acceptable to society is fundamentally flawed.

2. Sexual Freedom vs. Social Responsibility Not only Islam but all recognized human societies impose restrictions on any sexual gratification where an individual seeks to attain sexual pleasure but is unwilling to fulfill the associated social roles and responsibilities. In Islam and Eastern civilizations, a sexual relationship is not merely an individual act. Rather, it is directly linked to the formation of a family and the survival of the human race. When a man and a woman come together in a natural manner, a family is formed, children are raised, and civilization flourishes. Nature has attached social responsibilities to sexual pleasure specifically so that this sensual drive plays its role in civilizational progress. Conversely, homosexuality provides an escape route from this natural responsibility and strikes a fatal blow to the fundamental institution of the family.

3. Historical Evidence and the Disastrous Decline of Civilizations Those who cite ancient Greece, Rome, and ancient India in support of homosexuality conveniently forget a crucial lesson of history. If unnatural acts like homosexuality were promoted in these civilizations, it is a highly pertinent question to ask why these magnificent civilizations ultimately suffered a decline. The study of history indicates that the downfall of ancient civilizations is itself a clear sign that the Creator of the universe does not approve of this act. Despite the existence of homosexuality in various eras of history, no society could adopt it and sustain itself for a long period. Historical testimony does not favor homosexuality; rather, it stands against it.

4. Balance of Rights: The Individual and Society The greatest flaw in Western thought is that it views this entire matter merely as a mutual agreement between two individuals. However, this is fundamentally an issue of balancing the rights and responsibilities between the individual and society. If an action by two individuals destroys the family system of society and causes the fabric of civilization to disintegrate, the collective order of society can never tolerate it under the guise of individual freedom.

In short, the drive and passion placed within the human body and mind are intended for the building of human civilization. Freeing it from social responsibilities and reducing it to a philosophy of mere hedonism is an open rebellion against both human nature and survival.
